These Terms of Service ("Terms") govern your use of EarWorm ("EarWorm", "we", "us", or "our"), including the EarWorm website, games, accounts, leaderboards and related services.
By using EarWorm, you agree to comply with these Terms. If you do not agree with these Terms, you should not use EarWorm.
EarWorm is operated by Oliver Ballard.
EarWorm is a music quiz game that allows users to identify songs and, where applicable, save game results and participate in leaderboards.
You may use certain EarWorm gameplay features without creating an account. Some features, including account-based game history and leaderboards, require an EarWorm account.
You agree to use EarWorm only for lawful purposes and in accordance with these Terms.
Certain EarWorm gameplay features may be used without an account by users of any age.
You must be at least 13 years old to create or use an EarWorm account.
When creating an account, you must confirm that you are at least 13 years old. You must not create an account on behalf of, or for the use of, someone under 13.
If we become aware that an account has been created or used by someone under 13, we may suspend or close the account and take appropriate steps regarding information associated with the account.
If you create an EarWorm account, you are responsible for providing accurate information and keeping your account credentials secure.
You must not share your password or authentication credentials with other people or allow another person to use your account in a way that breaches these Terms.
You should notify us if you believe that your account has been accessed without your permission or that your account credentials have been compromised.

EarWorm may record game results for users who are logged in and use features that save game results.
Usernames and scores may be displayed publicly on EarWorm leaderboards. Other private account information, such as email addresses and passwords, will not be displayed on public leaderboards.
Scores are calculated based on gameplay and the information available to EarWorm at the time the game is played.
We may remove, modify or invalidate scores where we have reasonable grounds to believe that they were obtained through cheating, exploitation of a bug, manipulation of the service or another violation of these Terms.
We may change, suspend or discontinue individual leaderboards or leaderboard features where reasonably necessary to operate or maintain EarWorm.
EarWorm uses the Deezer API and may retrieve information about playlists and tracks from Deezer when you provide a Deezer playlist URL.
Deezer is a separate service and is not operated or controlled by EarWorm. Your use of Deezer may be subject to Deezer's own terms, policies and conditions.
EarWorm does not guarantee the availability, accuracy or continued operation of services provided by Deezer or other third parties.
Changes to third-party services, including changes to APIs, availability or technical requirements, may affect EarWorm's functionality.
Unless otherwise stated, EarWorm and its original content, branding, design, software and other materials are owned by or licensed to EarWorm or its operator.
You may use EarWorm for its intended purpose, but using EarWorm does not give you ownership of its software, branding, graphics or other intellectual property.
Deezer, music recordings, artwork, artist names, album information and other third-party materials remain the property of their respective owners and may be subject to separate rights and licences.
You may provide information to EarWorm, including Deezer playlist URLs and information required to create an account.
You must have the right to provide any information or content that you submit to EarWorm and must not knowingly submit content that is unlawful or infringes another person's rights.
EarWorm may process information you provide as described in our Privacy Policy.
We aim to keep EarWorm available and functioning correctly, but we do not guarantee that the service will always be available, uninterrupted or error-free.
EarWorm may occasionally be unavailable because of maintenance, technical problems, security incidents, third-party service interruptions or other circumstances.
We may add, change, suspend or remove features of EarWorm where reasonably necessary to operate, maintain, improve or secure the service.
You may stop using EarWorm or request deletion of your account at any time.
We may suspend or terminate an account where reasonably necessary, including where:

You must not attempt to bypass or interfere with security measures used by EarWorm.
If you discover a security vulnerability in EarWorm, please report it to us rather than attempting to exploit it or access information that you are not authorised to access.
EarWorm is provided for its intended entertainment and gaming purposes.
We aim to provide accurate and reliable functionality, but we cannot guarantee that all game information, playlist information, scores or other content will always be complete, accurate or available.
EarWorm may depend on third-party services, including the Deezer API. We are not responsible for interruptions or changes to third-party services that are outside our reasonable control.
Nothing in these Terms excludes or limits any liability or legal right that cannot lawfully be excluded or limited under applicable law.
To the extent permitted by applicable law, we will not be responsible for losses or damage resulting from your misuse of EarWorm, your breach of these Terms, or circumstances outside our reasonable control.
Nothing in these Terms excludes or limits liability for matters that cannot legally be excluded or limited, including liability that cannot lawfully be excluded under applicable UK law.
We may update these Terms from time to time to reflect changes to EarWorm, applicable law or the way the service operates.

Where we make significant changes that materially affect users, we will take reasonable steps to bring those changes to users' attention where appropriate.
Your continued use of EarWorm after updated Terms take effect constitutes acceptance of the updated Terms, where permitted by applicable law.
These Terms are governed by the laws of England and Wales, except where applicable law requires otherwise.
Nothing in these Terms affects any rights you may have under mandatory consumer protection or other applicable laws.
